May 2, 2017 – Firm partner Joni Thome took part in a panel discussion at the Minnesota CLE’s Workers’ Compensation Institute to discuss the employment law claims workers’ compensation practitioners should look for in their practice. Joni, a Minnesota State Bar Association Certified Employment Law Specialist, joined workers’ compensation attorney and expert Tom Atkinson to share their experiences in jointly representing clients who have both workers’ compensation and employment-related claims.
Employees who have been injured on the job often hire workers’ compensation attorneys to help them navigate the workers’ compensation system, file a claim and recover damages for their injuries. These employees may also have employment law claims arising from their work situation that are separate from the workers’ compensation system. At the Workers’ Compensation Institute, Joni and Tom discussed the signs and symptoms of workers’ compensation retaliation and obstruction claims, as well as Family and Medical Leave Act claims, age discrimination, disability discrimination and reasonable accommodation that may accompany the employer’s treatment of the injured worker. Their presentation included strategic considerations for practitioners, pitfalls to avoid and proactive steps to take together and separately to build the best case and settlement for their mutual clients.
