      July 24, 2017 – Firm attorney Dustin Massie was published in the July 2017 issue of the Hennepin Lawyer, the official publication of the Hennepin County Bar Association. His article, “When a Hostile Work Environment Becomes Legally Actionable,” examines the landscape of employee rights relating to unlawful workplace harassment. With recent allegations of workplace harassment—particularly sexual harassment—dominating our news cycles, employers are becoming increasingly conscious of the liability created by a hostile work environment.

      In the article, Massie outlines the various forms of harassment that can arise in a workplace and explains how an employer can be held accountable. Further, he examines employer liability in supervisor-employee harassment, employee-employee harassment, and harassment from third parties, including non-employees. Massie emphasizes that employers who fail to take appropriate and timely action after receiving reports of a hostile work environment may face liability, but “promoting a culture of reporting workplace harassment and taking swift action to protect harassed employees will limit an employer’s risk of being sued.”

      Whether the harassment is based on sex, race, age, disability or another protected status, hostile work environments are far from a thing of the past. However, protections for employees are becoming more robust as courts find employers liable for failing to prevent and protect their employees from the various forms and sources of workplace harassment.
