The two-day conference, attended primarily by employment attorneys and human resource professionals, provides educational programming and resources in all areas of employment law. Attorneys Chris Jozwiak and Joni Thome were again honored to serve as faculty at this year’s event.
Thome spoke alongside her long-standing defense colleague Kate Mrkonich-Wilson on the latest cases and developments impacting disability discrimination cases. Similarly, Jozwiak spoke on a separate panel focused on “Cutting-Edge ADA Accommodation and Retaliation Developments.” In both talks, topics included: the broadened scope of protected conduct after the amendments to the ADA, the increased rates of disability discrimination and retaliation claims, the impact of but-for causation on retaliation claims in disability cases and the scope of accommodation obligations in complicated health conditions.
Indeed, the ADA Amendment Act of 2008 (ADAAA) brought significant changes to the landscape of disability discrimination and retaliation litigation. The focus is no longer complicated battles over whether a plaintiff suffers from a covered disability. Instead, the central issue is whether the conduct at issue was motivated by bias based on a disability. Further, the scope of protection against retaliation has increased and the obligation not to retaliate can arguably arise in circumstances that in the past might not have been triggered.
